Terms of Service

These terms cover your use of AppFly, the software that builds Shopify apps from a description, and the accounts and apps you create with it. By creating an account you accept them.

Please read this firstAppFly is a developer tool. These documents describe what the software does and what it does not do with data, and they are written to match the code in this repository. They are not a substitute for review by a qualified lawyer in your jurisdiction before you rely on them in a commercial agreement.

The service

AppFly runs a coding agent inside a container on our infrastructure, writes an application from a description you give, installs it, and lets you change it by asking for the change in plain language. Every plan is described on the pricing section of our home page and in the app itself, and those descriptions are part of these terms.

We may add, change or remove features. Where a change removes something you are paying for, we will tell you before it takes effect. We may also change these terms; the version that binds you is the one published here on the date your account was created or, for later changes, from 30 days after we publish them.

We do not promise a specific build time, a specific uptime or a specific result. What we promise is the mechanism: an agent writes real code, you can read all of it, and you can take it with you.

Your account

You are responsible for the credentials on your account and for everything built under it. One person or one company, one account: accounts are not shared, resold or transferred without our written agreement.

You must be old enough to enter a contract where you live, and you must not be barred from receiving our services under any applicable law or sanctions regime.

Tell us promptly if you believe someone else has used your account. Until we can check, you are responsible for what happened under it.

What you own

You own everything an app makes. The generated source code, the schema, the assets and the databases your apps create are yours from the moment they exist, whether or not you have paid us anything for them.

You keep all rights in the descriptions, files and screenshots you give AppFly. You grant us only the licence we need to run the service for you: to store that material, to process it to build and operate your apps, and to display it back to you.

If you use a provider key in an app you build, that key stays yours and remains subject to that provider's terms, not ours.

Acceptable use

Building illegal content, content that infringes someone else's rights, or content that attacks, defames or deceives people is not allowed. The Acceptable Use Policy sets this out in full and is incorporated into these terms by reference.

You may not use AppFly to probe, scan or interfere with infrastructure that is not yours, to resell access to the underlying agent accounts we integrate with, or to attempt to reach another tenant's data or another app's database.

Fees, plans and taxes

Paid plans are billed in advance through our payment processor, monthly or yearly. The processor takes the payment; we never see or store your card number. Prices exclude sales tax, which is added where the law requires it.

A plan's limits — how many apps you may keep, how many you may run at once, how many you may deploy, and the monthly ceiling on agent usage — are part of the plan and are enforced by the product. A change to your plan takes effect on the billing date shown in the app.

Cancelling returns you to the free plan's limits. Nothing is deleted when you downgrade: apps over the new limit are paused and can be resumed by deleting back under the cap or by upgrading again. See the Privacy Policy for what happens to the apps themselves if you close your account instead.

Ending the agreement

You may close your account at any time from the app. We may suspend or close an account that breaks these terms, that is being used to attack the service or another tenant, or that we are required to act on by law. Where the situation allows it we will tell you why and give you a chance to fix it first.

On closure your apps, their databases, their files, their deployments and their DNS records are deleted, on the schedule described in the Privacy Policy. We keep nothing of yours afterwards except where the law requires us to keep a record.

Warranties and liability

The service is provided as is. We do not warrant that it will be uninterrupted, that generated code will be error-free, or that a particular app will be accepted by Shopify — Shopify reviews and approves every app submitted to its ecosystem, and that decision is not ours to make.

To the fullest extent the law allows, neither of us is liable for indirect or consequential loss, or for lost profits, revenue or data, arising from the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

Nothing here limits liability that cannot lawfully be limited, including for fraud or for anything else a consumer protection law refuses to let a supplier exclude.

Changes to the code

Because a coding agent writes the code, your app's behaviour is a function of the description you gave. You are responsible for reviewing what it produced before you ship it to customers, and for anything your app does once it is live. We provide the mechanism, not the outcome.
